Where design protection fits
The Designs Act, 2000 protects the features of shape, configuration, pattern, ornament or composition of lines or colours applied to an article — anything judged solely by the eye. It covers the aesthetic, not the functional.
This is the gap between patents and trademarks. A patent protects how a product works. A trademark protects the brand identifying its source. A design registration protects how the product itself looks. A distinctive bottle silhouette, a furniture profile, a textile print, a phone case form factor, a jewellery pattern, a packaging shape — these are design subject matter.
Two requirements are strict. The design must be new or original, meaning not published or made available to the public anywhere in the world before the filing date. And it must be applied to an article by an industrial process. Publishing your product on Instagram or listing it for sale before filing destroys novelty in exactly the way it does for patents.
Design registration is comparatively quick and inexpensive — a strong reason for consumer-product businesses to file before launch rather than after copies appear.
