The terms on which AshuTrust provides its services.

1. About these terms
These terms govern your use of this website and the professional services provided by AshuTrust. By engaging us, you accept these terms. Where we issue a separate engagement letter for a specific matter, that letter prevails over anything inconsistent here.
2. Nature of our services
AshuTrust provides professional assistance with intellectual property and corporate filings in India, including searches, drafting, filing, prosecution and related advisory work. Information published on this website is general in nature. It is not legal advice for your specific circumstances, and reading it does not create a professional relationship between us.
3. No guarantee of outcome
Outcomes in registry proceedings depend on the facts of each matter, the examiner or Controller's assessment, third-party actions such as oppositions, and applicable law. We undertake to carry out the work competently and diligently. We do not and cannot guarantee that any application will be accepted, registered or granted, that an objection will be overcome, or that any particular timeline will be met.
4. Scope of engagement
The services covered are those set out in the package you select or the quotation we issue. Work outside that scope — for example an opposition arising on a matter engaged only for filing, a divisional application, or an appeal — is quoted separately and undertaken only on your written instruction.
5. Your responsibilities
- Provide accurate, complete and truthful information and documents.
- Respond promptly to our requests, particularly where a statutory deadline applies. Registry deadlines are strict and we cannot extend them.
- Inform us of any prior use, existing rights, earlier applications or disclosures that could affect the matter.
- Ensure you are entitled to apply for the right in question and that you own or are licensed to use it.
We rely on the information you give us. We are not liable for consequences arising from information that was inaccurate, incomplete or withheld.
6. Fees
- Professional fees are the amounts we charge for our work. They are fixed and quoted before work begins, and are exclusive of GST, which is charged at the applicable rate.
- Government fees are statutory amounts payable to the relevant authority. We collect them from you and pay them across at cost, without markup. They are shown separately on every invoice.
- Government fees are non-refundable in all circumstances, including where an application is objected to, opposed, refused, abandoned or withdrawn. This is a statutory rule, not our policy.
- Fees quoted on this website are starting points and may vary with the complexity of your matter.
7. Refunds
Our professional fee is refundable in full if you cancel before we have begun substantive work on your matter. Once drafting, searching or filing has commenced, the professional fee is not refundable, as the work has been performed. Full details are set out in our Refund Policy.
8. Timelines
Timelines shown on this website are typical ranges based on our experience. Actual timelines depend on registry workload, examination queues, objections, oppositions and hearing schedules — none of which is within our control. Delays attributable to the registry do not entitle you to a refund.
9. Confidentiality
We treat information about your matter as confidential and do not disclose it except as necessary to perform the services, or where required by law. Note that information filed with a registry generally becomes part of a public record. For unfiled inventions we are happy to sign a non-disclosure agreement before you share technical detail.
10. Intellectual property in our materials
The content, structure and design of this website are owned by AshuTrust. You may read and share it for personal or internal business purposes. You may not reproduce it commercially, or republish it as your own, without written permission.
11. Limitation of liability
To the extent permitted by law, our total liability arising out of or in connection with any matter is limited to the professional fees actually paid to us for that matter. We are not liable for indirect, incidental or consequential losses, including loss of profit, revenue, goodwill or business opportunity.
Nothing in these terms limits liability for fraud, or for anything that cannot lawfully be limited.
12. Termination
Either party may terminate an engagement on written notice. On termination we will hand over the file and account for fees. You remain responsible for any government fees already incurred and for professional fees for work already performed. We may decline or discontinue an engagement where there is a conflict of interest, where instructions would require us to act improperly, or where fees remain unpaid.
13. Governing law
These terms are governed by the laws of India. Courts at Lucknow, Uttar Pradesh have exclusive jurisdiction over any dispute arising from them.
