The renewal timeline you need to know
A trademark registration in India is valid for ten years from the date of application, not the date the certificate was issued. Renewal must be filed on Form TM-R and can be submitted up to one year before expiry.
If you miss the expiry date, there is a six-month grace period during which renewal is still possible on payment of a surcharge. After that, the Registrar may remove the mark from the register. Restoration is possible between six months and one year from expiry, on a higher fee and at the Registrar's discretion.
Once a mark is removed, third parties become free to apply for it. Recovering a lapsed mark that someone else has since filed for is difficult and expensive. The practical answer is simple: docket the renewal date the moment the certificate is issued.
