What trademark registration actually gives you
A trademark is any mark capable of distinguishing your goods or services from someone else's — a brand name, logo, tagline, label, shape, or a combination of these. Registration under the Trade Marks Act, 1999 gives you the exclusive statutory right to use that mark for the goods or services it covers, and the right to stop others from using anything deceptively similar.
Without registration you are left relying on passing-off, which requires you to prove reputation and damage in court — slow, expensive and uncertain. With registration you hold a certificate that is prima facie proof of ownership across India, valid for ten years and renewable indefinitely.
Registration also unlocks practical things founders need: the ® symbol, marketplace brand registry enrolment on Amazon and Flipkart, franchising and licensing income, customs recordal against counterfeit imports, and a balance-sheet asset that investors and acquirers actually value during diligence.

Search and clearance

Application filed electronically with the Trade Marks Registry. You receive the application number the same day and can begin using ™ immediately.

Examination and reply
The Registry issues an examination report. If objections are raised under Section 9 or 11, we draft and file a reasoned reply with supporting evidence, and attend the hearing if one is listed.

Journal publication
On acceptance the mark is advertised in the Trade Marks Journal. A four-month window opens during which third parties may oppose.

Registration certificate
If unopposed, the Registry issues the registration certificate. Protection is backdated to your original filing date.

What you need to provide
Have these ready and the filing moves quickly. We tell you if anything is missing before we start.
For every applicant
- Clear soft copy of the logo or wordmark (JPEG, preferably 8cm × 8cm)
- List of goods or services the mark will be used for
- Applicant name, address and nationality
- Signed Form TM-48 (Power of Attorney) — we prepare this for you
- Date of first use, plus evidence, if the mark is already in the market
Individual or proprietorship
- PAN card of the applicant
- Aadhaar or passport as address proof
- Udyam / MSME certificate to claim the reduced ₹4,500 fee
Company, LLP or partnership
- Certificate of Incorporation or LLP agreement
- Company PAN
- Udyam registration or DPIIT startup recognition, if claiming the reduced fee
- Board resolution or authorisation for the signatory

Government fees are charged per mark per class and are non-refundable, including where an application is objected to or refused. There is no government fee for filing an examination reply or attending a hearing.
