Questions about classes

Class selection is where a lot of filings go wrong. These are the questions worth resolving before you file.

How do I choose the right trademark class?
Start with what you actually sell or provide today, then add anything you will launch in the next year. Goods fall in classes 1–34, services in 35–45. A clothing brand that also sells online typically needs Class 25 for the garments and Class 35 for the retail service. If you are unsure, describe your business to us and we will map it.
Can I file in multiple classes?
Yes, in a single multi-class application. Each class carries its own government fee — ₹4,500 for individuals, startups and MSMEs, or ₹9,000 for companies — so a three-class filing costs three times the single-class fee.
What happens if I file in the wrong class?
Your registration protects you only for the goods and services in the classes you filed. Filing in the wrong class means a competitor can use your name in the class that actually matters. Classes cannot be changed after filing — you would need a fresh application and a fresh fee.
Should I file in as many classes as possible?
No. Overbroad specifications attract objections, cost more in fees, and expose the registration to non-use cancellation after five years. File the classes your business genuinely covers, plus realistic near-term expansion.
Which class is software in?
It depends on the form. Downloadable software and mobile apps go in Class 9. Software provided as a service, cloud platforms and software development services go in Class 42. Most SaaS businesses file both.
Is a trademark class the same across countries?
The NICE Classification is used internationally, so class numbers mean the same thing in most countries. The specification wording accepted within each class can still differ between registries.
