    Written risk opinion

    You receive a report listing conflicting marks with owner, class and status, an overall risk rating, and a clear recommendation on whether to proceed.

Is the free search on the IP India website enough?
No. It finds exact matches in one class. Refusals overwhelmingly come from phonetic similarity, visual similarity, transliterations and marks in adjacent classes — none of which that tool surfaces reliably.
How long does a trademark search take?
A quick availability signal takes about 24 hours. A full clearance report with a written risk opinion takes two to three working days.
Does a clean search guarantee registration?
No search can guarantee an outcome. Applications filed but not yet published are not visible, and examiners exercise judgement. A thorough search substantially reduces risk but does not eliminate it.
Can I search a logo, not just a name?
Yes. Device marks are searched using Vienna classification codes for the visual elements, alongside any word elements in the logo.
What if my search shows a conflict?
You have options: modify the mark so it is distinguishable, file in a different class, negotiate a consent or coexistence agreement with the prior owner, or file a rectification if the earlier mark has been unused for five years. We set out which is realistic in your report.
