Why the order actually matters here
These three registrations are independent — none legally requires another first — but the sequence changes your costs and avoids rework. The one dependency worth planning around: your trademark government fee is ₹4,500 per class with a valid Udyam (MSME) or DPIIT startup certificate, versus ₹9,000 per class without one. Getting Udyam registration before filing the trademark is the single highest-value ordering decision in this list.
Step 1: settle the business structure and name search together
Before registering anything, run a trademark clearance search on the name you intend to use — for the business itself and, separately, for any product brand within it. MCA name approval for a company or LLP does not check the trademark register, so a business name can be approved and incorporated and still infringe someone else's registered mark. Clear the name first; everything else is built on top of it.
Step 2: Udyam registration, because it's free and unlocks the trademark discount
Udyam registration (udyamregistration.gov.in) is free, based on self-declared investment and turnover, and typically takes minutes for a straightforward business. There is no reason to file a trademark before completing this, since doing so forfeits the ₹4,500-per-class discount permanently for that application — it cannot be claimed retroactively after filing.
Step 3: GST registration, once turnover requires it or once you need it for B2B credibility
GST registration is mandatory past the applicable turnover threshold, and is often taken voluntarily earlier because B2B buyers and marketplaces frequently require a GSTIN before onboarding a vendor. There is no fee for GST registration itself. It has no bearing on trademark timing or cost, so it can run in parallel with the trademark filing rather than before it.
Step 4: file the trademark once Udyam is in hand
With Udyam registration complete, file the trademark at the reduced government fee. Filing early matters independently of the sequencing above — India runs on a first-to-file system for most disputes, so every week between clearing a name and filing it is a week someone else could file first.
A reasonable default order
Trademark clearance search → incorporation or proprietorship setup (if a formal structure is needed) → Udyam registration → trademark filing → GST registration once required. The only genuinely costly mistake in this list is filing the trademark before Udyam is in place; everything else is flexible.
